Terms and Conditions

1. Agreement to Terms

By accessing and using the services of Australian Credit Solutions (ASIC License ACL 532003), you agree to be bound by these Terms and Conditions.

If you do not agree to these terms, please do not use our services.

2. Services Provided

Australian Credit Solutions provides credit repair and credit file correction services, including but not limited to:

  • Credit file analysis and assessment
  • Dispute lodgement with credit reporting bodies (Equifax, Experian, Illion)
  • Communication with credit providers regarding incorrect listings
  • Removal or correction of defaults, judgments, and other credit file errors
  • Credit score improvement strategies
  • Credit file education and guidance

What We Do NOT Provide:

  • Legal advice (except as provided by our qualified legal staff)
  • Financial planning or investment advice
  • Debt consolidation loans
  • Guarantee of specific credit score outcomes
  • Guarantee of loan approval from third-party lenders

3. Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Be an Australian citizen or permanent resident
  • Provide accurate and truthful information
  • Have the legal capacity to enter into a binding agreement
  • Authorize us to act on your behalf with credit reporting bodies and creditors

4. Fees and Payment Terms

4.1 Fee Structure

Upfront Admin Fee: $330 (GST inclusive)

This covers:

  • Credit report retrieval from all three bureaus (Equifax, Experian, Illion)
  • Professional credit file analysis
  • Case file setup and documentation
  • Initial dispute lodgement

Success Fee: Charged only upon successful removal of credit file listings. Fee amount varies based on complexity. Success fees are only charged for items actually removed.

4.2 No Win, No Fee Policy

Where applicable, clients may qualify for a No Win, No Fee arrangement, meaning you pay the upfront admin fee ($330) and success fees only if we successfully remove items from your credit file.

4.3 Payment Methods

We accept: Credit card (Visa, Mastercard, American Express), Debit card, Bank transfer, PayPal.

4.4 Refund Policy

Admin fees are non-refundable once credit reports have been pulled and case analysis has begun. Success fees are only charged upon successful removal, so there is no refund scenario for success fees.

5. Client Obligations

As a client, you agree to:

  • Provide accurate information β€” All details must be truthful and complete
  • Respond to requests β€” Timely responses to our requests for documents or information
  • Authorize credit bureau access β€” Grant permission for us to obtain your credit reports
  • Cooperate with the process β€” Provide necessary documents
  • Not engage in fraud β€” Any attempt to defraud will result in immediate termination
  • Notify us of changes β€” Update us on address changes or relevant circumstances

6. Our Obligations

Australian Credit Solutions agrees to:

  • Operate legally β€” All actions comply with the Privacy Act 1988, Credit Reporting Code, and ASIC regulations
  • Act in good faith β€” We will pursue your case diligently and professionally
  • Maintain confidentiality β€” Your information is kept private and secure
  • Provide honest assessments β€” We only take cases we believe have reasonable grounds for success
  • Keep you informed β€” Regular updates on case progress
  • Charge only for results β€” Success fees only apply when items are successfully removed

7. No Guarantees

IMPORTANT: Credit repair outcomes depend on multiple factors beyond our control. We cannot guarantee specific credit score improvements, removal of all defaults or judgments, approval for loans, or specific timeframes.

We can guarantee: Professional, legally compliant service; good faith efforts to remove incorrect listings; honest assessment of your case; no success fees unless we achieve results.

8. Timeframes

Typical Case Resolution: Most cases are resolved in 2-8 weeks, though complex cases may take 8-12 weeks or longer.

We are not responsible for delays caused by credit bureaus or creditors exceeding their response timeframes, client delays in providing requested information, or force majeure events.

9. Termination

Termination by You: You may terminate our services at any time by providing written notice (email acceptable). Upon termination, admin fees already paid are non-refundable and success fees for items already removed will be charged.

Termination by Us: We reserve the right to terminate services if you provide false information, fail to pay agreed fees, engage in abusive behavior, or we determine the case has no reasonable legal grounds for success.

10. Privacy and Data Protection

We collect and store personal details, credit reports, financial information relevant to your case, and correspondence. Your information is used to provide credit repair services, communicate with credit bureaus and creditors on your behalf, and keep records as required by ASIC regulations.

We do not sell or share your personal information with third parties, except credit reporting bodies and creditors as necessary to dispute listings, or legal/regulatory authorities if required by law.

11. Disclaimers and Limitations of Liability

Unless specifically provided by our qualified legal staff, information provided does not constitute legal advice. We are not responsible for decisions made by credit bureaus or creditors, delays or errors by third parties, or changes to credit reporting laws.

To the maximum extent permitted by law, our liability is limited to the fees you have paid for our services. Nothing in these terms excludes your rights under the Australian Consumer Law.

12. Complaints and Dispute Resolution

Internal Complaints: Contact us in writing at admin@australiancreditsolutions.com.au. We will acknowledge receipt within 2 business days and respond within 30 days.

External Dispute Resolution: If not satisfied with our internal resolution, you may lodge a complaint with the Australian Financial Complaints Authority (AFCA) at www.afca.org.au or call 1800 931 678.

13. Governing Law

These Terms and Conditions are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

14. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated β€œLast Updated” date. Your continued use of our services after changes are posted constitutes acceptance of the updated terms.
